Terms of Use

Welcome to loco. We are glad to have you here. These Terms of Use, our Privacy Policy, and all policies posted on our platform set out the terms on which we offer you access to and use of our site, services, applications, and tools (collectively "Services"). All policies are incorporated into these Terms of Use. By using loco, you agree to comply with all of the following.
1. YOUR ACCOUNT
To access certain features of loco, you may be required to create an account with your email and password.
- Responsibility: You are solely responsible for all activities under your account and for keeping your password confidential.
- Transfer: You may not transfer your account to another party without our express written consent.
- Third-Party Login: If you connect via a third-party service (e.g., Google or Apple), you authorize us to access and use your information as permitted by that service and our Privacy Policy.
- Eligibility: You must be at least 13 years old to use loco. By using loco, you represent that you meet this requirement.
2. USING LOCO (COMMUNITY RULES)
You agree to post in the appropriate category and will NOT engage in the following:
- Illegal Acts: Violate any Canadian federal or provincial laws or our Prohibited Content Policy.
- Deception: Post false, misleading, or libelous content.
- Infringement: Infringe any third-party rights (Copyright, Trademark, etc.).
- Spam: Distribute spam, chain letters, or pyramid schemes.
- Harmful Tech: Distribute viruses or technologies that may harm loco or its users.
- Scraping: Use any robot, spider, scraper, or automated means to collect content from loco for any purpose without our express written permission.
- Data Harvesting: Collect information about others, including email addresses or phone numbers, without their consent.
3. ABUSE & MODERATION
Please use our flagging system to report offensive content or problems.
- Our Right: We reserve the right to limit or terminate our Services, remove hosted content, and take technical/legal steps to keep users off loco if we believe they are creating problems or acting inconsistently with the spirit of our policies. LOCO reserves the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.
- No Liability: Regardless of whether we take action, loco does not accept liability for monitoring the platform or for unauthorized or unlawful content posted by users.
Upon account deletion, your personal information will be handled in accordance with our Privacy Policy. Some content you posted may remain visible but will no longer be associated with your account.
4. FEES
- Free for General Users: Using loco to browse listings, search for service providers, and contact other users is generally free of charge.
- Advertising Fees: While browsing is free, loco may offer optional paid features, such as promoted ads, featured listings, or third-party advertisements. If you choose to use these advertising services, you will be notified of the fees at the time of purchase, and by using them, you agree to pay the associated charges.
- Currency: All fees (for subscriptions or future advertising) are quoted in Canadian Dollars (CAD).
- Non-Refundable: All fees paid to loco are non-refundable, except where required by the consumer protection laws of British Columbia.
- Taxes: Applicable Canadian taxes (GST/HST/PST) will be collected where required by law. You are responsible for any taxes arising from the sale of your items or the performance of your services.
5. CONTENT & INTELLECTUAL PROPERTY
- Your Content: When you post content, you grant loco a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to use, copy, display, and distribute that content for the purpose of operating and promoting the platform.
- Our Rights: You agree not to copy, modify, or distribute loco's copyrights or trademarks.
- Reporting Infringement: If you believe your intellectual property rights have been violated, please contact loco Customer Support. Only the rights owner may report infringing listings.
Your use of loco is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
LOCO may collect and use your location data (with your consent) to provide local community features. You can manage location permissions in your device settings.
6. REVIEWS
Users may be asked to leave reviews (1-5 stars).
- Integrity: Reviews must be truthful, left in good faith, and must not be used to harass or mislead others.
- Finality: To ensure the integrity of the system, loco generally does not edit or remove reviews unless they violate our safety policies.
7. DISCLAIMERS AND LIMITATION OF LIABILITY
- "As Is": loco is provided "as is" and "as available." Most content comes from users; therefore, we do not guarantee the accuracy, safety, or legality of what is offered.
- LOCO does not act as a buyer, seller, employer, or contractor in any transaction between users.
- loco may display advertisements and sponsored content. Such content does not imply endorsement by loco.
- No Warranty: To the extent legally permitted, we disclaim all warranties and conditions, express or implied, including merchantability and fitness for a particular purpose.
- Liability Limit: loco is not liable for any loss of money, goodwill, or reputation. If found liable, our liability is limited to the greater of (a) the total fees you paid us in the 12 months prior, or (b) 100 Canadian Dollars.
7.1 No Liability for Services
loco is a platform that allows users to discover and connect with independent Service Providers (such as tutors, estheticians, etc.).
- No Endorsement: loco does not screen, interview, or background check Service Providers. The inclusion of a provider on our platform does not constitute an endorsement or guarantee of their skills, safety, or legality.
- User Responsibility: You are solely responsible for exercising caution and using your own judgment before hiring or meeting a Service Provider. We strongly recommend meeting in public places for the first time and verifying the provider's qualifications yourself.
- Assumption of Risk: You acknowledge and agree that any interaction, communication, or transaction between you and a Service Provider is strictly at your own risk.
LOCO is not responsible for service interruptions caused by events beyond our control (e.g., server outages, natural disasters).
7.2 Release of loco
- Direct Disputes: Any dispute regarding service quality, injury, property damage, or payments must be resolved directly with the Service Provider. loco is not a party to any agreement between you and a provider.
- Liability Waiver: To the fullest extent permitted by the laws of British Columbia, you agree to release loco, its directors, and employees from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with your interactions with Service Providers found through our platform.
8. INDEMNIFICATION
You will indemnify and hold harmless LOCO and its officers, directors, and employees from any claim made by a third party arising from your use of the Services or your violation of any law or the rights of a third party.
9. GENERAL
- Governing Law: These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada. Any dispute arising from these Terms shall be resolved through binding arbitration in British Columbia.
- Updates: We may update this agreement at any time. Updates take effect when you next use the site or after 30 days, whichever is sooner.
- Language: The parties have expressly requested that these Terms be drawn up in English. (Les parties ont expressément exigé que les présentes conditions soient rédigées en anglais.)
MOBILE DEVICES TERMS
If you are accessing loco's Services from a mobile device using the loco mobile application (the "Application"), these Mobile Devices Terms apply to you in addition to our general Terms of Use and Privacy Policy. By using the Application, you agree to these terms.
1. APPLICATION USE
loco grants you a limited, non-transferable right to use the Application. You agree NOT to:
- Modify, copy, publish, license, sell, or commercialize the Application or any associated software.
- Rent, lease, or transfer rights to the Application to any third party.
- Use the Application in any way that could impair the service or interfere with other users' enjoyment.
Note: You must comply with all applicable third-party agreements (e.g., your wireless data plan) while using the Application. You acknowledge that certain functionalities may vary between the website and the Application depending on your device.
2. INTELLECTUAL PROPERTY
loco owns (or licenses) all rights, title, and interest in and to the Application, including patents, copyrights, trade secrets, and trademarks. You agree not to decompile, reverse-engineer, disassemble, or attempt to derive source code from the Application, nor will you remove or alter any proprietary notices (copyright, trademark, etc.) contained within it.
3. EXPORT CONTROL & TRADE REGULATIONS
The Application may be subject to export and trade regulations. You represent and warrant that:
- You are not located in a country subject to a Canadian or U.S. government embargo, or one designated as a "terrorist supporting" country.
- You are not listed on any Canadian or U.S. government list of prohibited or restricted parties.
4. ADDITIONAL TERMS FOR iOS (APPLE)
If you are using the Application on an Apple iOS device, you acknowledge and agree that:
- Agreement: These terms are between you and loco only, not with Apple. Apple is not responsible for the Application or its content.
- Maintenance: Apple has no obligation to furnish any maintenance or support services for the Application.
- Liability: Apple is not responsible for addressing any claims (e.g., product liability, legal non-conformance, or consumer protection) or third-party intellectual property infringement claims.
- Warranty: In case of any failure of the Application to conform to a warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligations.
- Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple has the right to enforce these terms against you.
5. ADDITIONAL TERMS FOR ANDROID (GOOGLE)
If you are using the Application on an Android device, you acknowledge and agree that:
- Agreement: These terms are between you and loco only, not with Google.
- Compliance: Your use of the Application must comply with Google's current Google Play Store Terms of Service.
- Google's Role: Google is only the provider of the store where you obtained the Application. Google has no obligation or liability to you regarding the Application or these terms.
- Third-Party Beneficiary: Google is a third-party beneficiary to these terms as they relate to the Application.
