Terms for Service Provider
1. Provider Responsibility & Qualifications
As a Service Provider on loco (e.g., tutor, esthetician, massage therapist, etc.), you are solely responsible for your own services.
- Competency: You represent that you possess the necessary skills and knowledge to perform the services you offer.
- Self-Compliance: You are responsible for knowing and following any local laws or regulations that apply to your specific service in British Columbia.
- No Verification by loco: You acknowledge that loco does not verify the identity, skills, or background of Service Providers. We provide a platform for connection only. You are responsible for maintaining any professional liability or insurance coverage required for your services. Users are encouraged to verify your credentials and qualifications independently, as LOCO does not conduct background or reference checks.
2. Independent Status
- No Employment: Service Providers are independent users and not employees or agents of loco.
- Taxes: You are responsible for managing your own income taxes and, if applicable, collecting and remitting GST/PST as required by Canadian law.
All agreements between Service Providers and customers are independent and do not create any partnership, joint venture, or employment relationship with LOCO.
3. Personal Safety & Conduct
- Meeting Users: Whether you provide services at your location, the customer's home, or a public space, you assume all risks associated with meeting and interacting with others.
- Professionalism: You agree to treat all customers with respect and maintain a safe environment. loco reserves the right to remove any provider who receives complaints of harassment or unprofessional behavior.
Service Providers must not engage in any illegal activities or provide services that pose unreasonable risk to themselves or others. LOCO recommends meeting clients in public places for the first session and following all applicable safety guidelines.
4. Disputes with Customers
- Direct Resolution: Any issues regarding service quality, timing, or payments must be resolved directly between you and the customer. loco will not act as a mediator in these disputes.
- Liability: loco is not liable for any physical injury, property damage, or financial loss that may occur during the performance of your services.
Any disputes between Service Providers and customers regarding payments, refunds, or service quality are solely between the parties. LOCO may provide guidelines but will not intervene.
5. Subscription Plans
To list and promote professional services on loco, service providers may be required to purchase a Monthly Subscription. By subscribing, you agree to pay the monthly fee as specified at the time of purchase.
5.1 Recurring Billing & Automatic Renewal
- Automatic Renewal: Your subscription will automatically renew each month on the same date you initially subscribed (the "Billing Date").
- Authorization: By providing a payment method, you authorize loco (or our third-party payment processor) to charge the then-current monthly subscription fee plus applicable Canadian taxes (GST/HST/PST) to your designated payment method.
Service Providers are responsible for ensuring that payment information is current. Failed or declined payments may result in suspension of service listing until resolved. All applicable taxes (GST/HST/PST) are the responsibility of the Service Provider.
5.2 Cancellation and Re-activation
- Cancellation: You may cancel your subscription at any time through your account settings. To avoid being charged for the next billing cycle, you must cancel at least 24 hours before your next Billing Date.
- Access after Cancellation: Upon cancellation, you will continue to have access to your provider benefits until the end of your current paid billing period.
- Re-activation: You may re-activate your subscription at any time. Upon re-activation, a new billing cycle will begin from the date of the new transaction.
5.3 Payment Information & Security
- Secure Processing: To ensure the highest level of security, loco does NOT directly store, view, or process your full credit card information or CVV on our own servers.
- Third-Party Processor: All payments are handled by a secure, PCI-compliant third-party payment processor (e.g., Stripe, PayPal).
- Personal Data: While we receive certain transaction details (such as the last four digits of your card or billing address for tax purposes), your sensitive financial data remains encrypted and handled exclusively by our payment service provider.
5.4 Refunds
Except as required by the British Columbia Consumer Protection Act, subscription fees are non-refundable. If you cancel mid-month, you will not receive a pro-rated refund for the remaining days of that billing cycle.
6. Data Privacy
LOCO may collect transaction logs and location data for operational purposes. Service Providers consent to this collection as necessary for platform functionality, while sensitive personal data is protected according to LOCO's Privacy Policy.
7. Termination & Suspension
LOCO reserves the right to suspend or terminate a Service Provider account at any time if the provider violates these Terms or the LOCO community policies. Termination may occur without prior notice in cases of serious misconduct.
8. Liability Limitation / Indemnification
Service Providers agree to indemnify and hold harmless LOCO, its officers, directors, and employees from any claims, damages, or losses arising from the services they provide. LOCO is not responsible for any injury, property damage, or financial loss resulting from interactions between Service Providers and customers.
